Terms of Use

These terms of use set out the rules for using the Gostly service, the rights and obligations of users, and the basic rules regarding plans, billing, content, and liability.

1. What is Gostly

Gostly is an online service for accommodation providers that helps simplify communication with guests during their stay. It allows users to manage guest information, messages, in-stay assistance, guest notifications, issue reporting, and other related features in one place.

Gostly is not a booking engine, channel manager, or full PMS system for managing reservations and pricing. The user is solely responsible for their own booking processes, business decisions, house rules, price lists, guest check-in requirements, and all other legal and operational obligations that are not expressly part of the Gostly service.

The Gostly service is intended for business users (accommodation providers), meaning that use takes place within their professional or commercial activity (B2B). Consumer-protection provisions therefore generally do not apply, except where their application is expressly required by mandatory law.

2. Acceptance of terms

By registering, accessing, or using the Gostly service, the user confirms that they have read, understood, and agreed to these terms. If the user does not agree to the terms, they must not use the service.

If the user uses the service on behalf of a company, association, or other organisation, they declare that they have appropriate authorisation to do so and that they may accept these terms on its behalf.

3. User account

  • Registration of a user account is required to use certain features.
  • The user must provide accurate, complete, and up-to-date information upon registration.
  • The user is responsible for keeping their access credentials and password secure, and for all activities carried out through their account.
  • If the user suspects unauthorised access to or misuse of their account, they must notify us immediately at hello@gostly.si.

4. Plans, billing, and price changes

Gostly may offer free, monthly, annual, or other usage plans. The scope of features, number of users, number of properties, limits, and price of each plan are defined on the Gostly website, in the offer, or in another agreed document.

Unless expressly stated otherwise, subscriptions are billed in advance for each billing period. The user agrees that we will charge the applicable subscription fee, taxes, and any other applicable costs for active paid plans in accordance with the current price list or offer.

Prices, plans, and features may change over time. For new users, changes may take effect upon publication of a new price list or on a date clearly stated therein. For existing subscribers, changes generally take effect after prior notice and at the start of the next billing period; for annual plans, generally upon renewal, unless the law provides otherwise or a different arrangement has been expressly agreed.

If Gostly offers the option of temporary suspension, a seasonal standby mode, or a similar arrangement, the conditions of such use will be set out in the price list, in the user account, or in a specific offer. If such an option is not expressly published or agreed, it is deemed not to be part of the standard subscription.

5. Permitted and prohibited use

The user may only use Gostly lawfully, in accordance with these terms, and for the purposes for which the service is intended.

In particular, the user must not:

  • use the service for illegal, misleading, offensive, or harmful purposes,
  • submit content that infringes the rights of third parties, applicable legislation, or public order,
  • attempt to gain unauthorised access to the system, other users' accounts, or connected networks,
  • disrupt the operation of the service, carry out automated attacks, scraping, or load-testing without our permission,
  • use Gostly to send unsolicited messages, malicious code, or other harmful content.

6. User content and data

The user retains ownership of the content, data, texts, translations, instructions, notifications, photographs, and other materials they enter into Gostly. By using the service, the user grants Gostly the right to process, store, display, and technically use such content to the extent necessary to provide the service.

The user is solely responsible for the accuracy, legality, and currency of the content they enter. This includes guest information, arrival instructions, house rules, contact details, notifications, responses in communications, and other content that Gostly displays or relays to guests on behalf of the user.

Where the user processes guests' personal data through Gostly, the user acts as the controller and Gostly acts as the processor in accordance with Article 28 of the General Data Protection Regulation (GDPR). The terms of such processing — including the types of data, purposes, security measures, and the processor's obligations — are governed by a Data Processing Agreement, which forms an integral part of this contractual relationship and is made available to the user on request or via the user account. Further information on data processing is set out in the Privacy Policy.

7. Communication with guests

Gostly enables communication between the accommodation provider and the guest. The user is responsible for ensuring they have an appropriate legal basis for using guests' contact details, for sending messages, and for delivering information that guests receive during their stay.

Gostly is not liable for the content of communications, instructions, or notifications prepared by the user, except to the extent expressly required by law. Where the service includes translations, automated suggestions, or other smart features, these are intended to assist with work and do not constitute legal, safety, or professional advice. The user must verify the accuracy of important information before sending it.

8. Service availability and support

Gostly strives to ensure reliable operation of the service, but does not guarantee that the service will always be available without interruptions, delays, or errors. Access to the service may be temporarily limited due to maintenance, upgrades, technical issues, security reasons, or factors beyond the provider's reasonable control.

Where support is included in a given plan, it is provided in the scope, manner, and response times set out in the price list, offer, or user documentation.

9. Limitation of liability

To the fullest extent permitted by applicable law, Gostly is not liable for indirect damages, lost profits, loss of data, business interruption, loss of reservations, damage arising from incorrect user information, or other consequential claims arising from the use of or inability to use the service.

Gostly's total liability for all claims related to the use of the service is limited to the amount the user has actually paid for the service in the 12 months preceding the event giving rise to the claim, unless applicable law provides otherwise.

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law.

10. Intellectual property

Gostly, its software, design, structure, knowledge base, trademark, logos, and other elements of the service are, except where expressly stated otherwise, owned by the provider or its licensors and are protected by applicable intellectual property legislation.

The user does not acquire ownership rights in the service, but rather a limited, non-exclusive, non-transferable, and revocable right to use the service in accordance with these terms.

11. Term, cancellation, and termination

These terms apply from the moment the user begins using Gostly and remain in effect until the user ceases using the service or the account is closed.

The user may stop using the free plan at any time. Paid plans may be cancelled in accordance with the rules set out in the price list, user account, or offer. Unless stated otherwise, cancellation takes effect at the end of the already-paid billing period.

Gostly may temporarily restrict access or close a user's account if the user breaches these terms, fails to settle outstanding obligations, uses the service in violation of the law, or poses a security or business risk to the service, other users, or third parties.

12. Changes to the terms

Gostly may periodically update these terms due to changes in the service, legislation, business model, or security reasons. The updated version will be published on this page with the date of the most recent update.

If the changes are material, we will notify users in an appropriate manner, for example by email, in the user account, or via a notice within the service.

13. Governing law and dispute resolution

These terms and all disputes arising from or related to the use of the Gostly service are governed by the law of the Republic of Slovenia.

The competent court for resolving disputes is the court of competent jurisdiction in Ljubljana, unless applicable law provides otherwise.
